A valid Florida saltwater fishing licence is REQUIRED at age 16 and older; Florida residents over 65 are exempt. Park is almost entirely in Gulf of America waters within Monroe County, FL. Florida FWC regulations apply with park-specific federal overlays — circle hooks only, J-hooks prohibited, spearfishing and lobstering prohibited park-wide, and the Research Natural Area is closed to all fishing.

What to know before you fish Dry Tortugas

  • Closed zones: the Research Natural Area is closed to ALL fishing — its boundary is marked on the water by large yellow buoys identifying the Historic Use Area extent. Fishing is permitted only outside the RNA. Garden Key (the main visitor island) is shore-fishable ONLY at four named spots: the seaplane beach east of the main dock when the seaplane is not present; the main dock when the Yankee Freedom is not present; the two westernmost finger piers when unoccupied; and either dinghy beach, provided fishing does not occur within 50 ft of the concrete wall of the historic docks and ruins previously used for loading coal. All other shore areas of Garden Key are closed to fishing. Boat fishing is permitted within the 1-mile Historic Use Area surrounding Garden Key.
  • Park-specific gear rule: only CIRCLE HOOKS may be used. 'J' hooks are NOT permitted in the park. Park-wide spearfishing is prohibited — all spearfishing gear (Hawaiian slings, pole spears, spearguns including rubber-powered / pneumatic / spring-loaded, air rifles, bows and arrows, powerheads, explosive-powered guns) must be broken down and stored so they are not available for immediate use while a vessel is inside park waters. Hand-held hooks, gigs, gaffs, and snares are prohibited EXCEPT a gaff may be used to land a fish lawfully caught by hook and line.
  • Bait + collection limits: bait fish may be taken by closely attended hook-and-line, dip net, or cast net, limited to 5 gallons per vessel per day. Shrimp may be taken by dip net or cast net. Only legally obtained finfish and shrimp may be reduced to harvest. Commercial fishing is prohibited except where authorised by federal statute. Digging for bait is prohibited. Bait-bucket dumping and introduction of any wildlife / fish / plant into a park ecosystem is prohibited.
  • Lobster: harvesting spiny lobster within the park is PROHIBITED entirely (including during Florida's sport season). Possessing lobster within park boundaries is prohibited unless the holder took it outside park waters with proper state and federal licences and permits. Vessels carrying legally taken outside-park lobster may not have any persons overboard in park waters — the presence of lobster aboard with anyone overboard constitutes prima facie evidence of in-park harvest. Legally taken speared fish or lobster obtained outside the park must be reported BEFORE entering park waters; once inside, the reporting vessel must transit through to its final anchoring / mooring location without stopping and without allowing passengers or crew to enter the water until the mooring is reached.
  • Operational requirements + general prohibitions: private boaters are REQUIRED to file a boat permit at Garden Key before fishing within the park (see the park's Boating webpage). Taking, possessing, or touching any ornamental tropical fish or marine life is prohibited. Fishing by drugs / poisons / explosives / electricity is prohibited; releasing fish carefully and immediately back to the water from which it was taken is required when the fish does not meet size / species rules or the angler chooses not to keep it; fishing from or within 200 ft of designated public floats, swim beaches, surfing areas, or public boat docks except in posted areas is prohibited. The Yankee Freedom ferry (the primary visitor transport from Key West) and the seaplane operation set most of the schedule for when Garden Key shore-fishing spots are actually available.
